A Hot Springs Village felon on probation who was caught with a loaded gun during a traffic stop by Hot Springs Village police last year was sentenced to 12 years in prison Monday after pleading guilty in Garland County Circuit Court.

Nicholas William Schrader, 39, who listed an Arias Way address when arrested, was set to stand trial Monday morning, but opted to plead guilty to possession of a firearm by certain persons as a habitual offender which increased the maximum penalty and was sentenced to 12 years in prison.

“He had more than five felony priors out of California and one from Garland County,” Deputy Prosecutor Caitlin Bornhoft said Monday, noting he was given a 20-year suspended sentence on a 2020 residential burglary charge.

“We sought to revoke that after his recent arrest and that revocation went to a hearing in Division 1,” she said. “He denied knowing about the firearm and Judge (Ralph) Ohm sentenced him to five years, but (Monday) he pled guilty and admitted to being in possession of the firearm.”

According to the probable cause affidavit, on April 16, 2022, HSV Police Officer Ryan Steed was patrolling in the area of DeSoto Boulevard and Fresno Road when he saw a BMW traveling westbound on DeSoto which crossed the centerline twice and was “weaving back and forth” in its traffic lane.

He stopped the vehicle near Fuego Way and made contact with the driver, identified as Schrader, and a computer check showed he did not have a valid driver’s license. It was then determined that none of the passengers had a license either, so Steed told Schrader the vehicle would have to be towed.

While doing an inventory of the vehicle prior to towing, officers found a loaded Rock Island M1911 .45-caliber handgun hidden under the plastic dash above the steering wheel. They also found three other fully loaded magazines for the gun inside the vehicle and after confirming Schrader was a felon he was arrested.

Schrader was released the next day on a $2,500 bond, but his bond was revoked on May 31 for using a controlled substance and he had remained in custody since then. He pleaded not guilty to the charge on July 6 and was set for trial Monday.
